AbilityPath Terms of Use

By using AbilityPath.org, a web site service of Community Gatepath, you hereby agree to accept the following terms and conditions (“Terms of Use”) and further agree to indemnify and hold harmless Community Gatepath, it’s officers, directors, experts, writers, funders and employees from any accidents, injuries, or direct or indirect damages of any kind which you may experience from supporting the development of children with special needs or use of AbilityPath.org (“AbilityPath” or the “Site”).

Community Gatepath may revise and update these Terms of Use at any time. Your continued usage of AbilityPath.org (“AbilityPath” or the “Site”) will mean you accept those changes. If the alterations constitute a material change to the Terms of Use, we will notify you via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.

Basic Terms

  1. You must be 13 years or older to use this site.
  2. You must provide a valid email address and any other information needed in order to complete the signup process.
  3. You are responsible for any activity that occurs under your screen name.
  4. You are responsible for keeping your password secure. Community Gatepath cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
  5. You must not abuse, harass, threaten, impersonate or intimidate other Site users.
  6. You must not writing anything abusive or what might be considered harassment or slander towards an individual, organization, school district or any other person and establishment on the Site.
  7. You may not use the AbilityPath.org service for any illegal or unauthorized purpose nor may you, in the use of the Site, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of the United States.
  8. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and display on the AbilityPath.org service.
  9. You must not create or submit unwanted email to any AbilityPath.org members ("Spam").
  10. You must not transmit any worms or viruses or any code of a destructive nature.

Violation of any of these agreements will result in the termination of your AbilityPath.org account

General Conditions

  1. We reserve the right to modify or terminate the AbilityPath.org service for any reason, without notice at any time.
  2. We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
  3. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
  4. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Site, use of the Site, or access to the Site without the express written permission by Community Gatepath.
  5. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.
  6. Technical support is provided to all account holders and is only available via email.
  7. By making your account information public, you agree to allow others to view your content.

Content You Submit to or Post on the Web site

Except as specified in our Privacy Policy, all communications from you to this Site will be considered non-confidential and non-proprietary. You agree that any and all comments, information, photos, videos, feedback and ideas that you communicate to AbilityPath or submit or post to the Web site or give AbilityPath permission to post to the Site (“User Content”) will be deemed, at the time of communication to AbilityPath or submission or posting to the Site, to be the property of AbilityPath, and AbilityPath shall be entitled to full rights of ownership, including without limitation, the unrestricted right to use or disclose such User Materials in any form, medium or technology now known or later developed, and for any purpose, commercial or otherwise, without compensation to you.

You also agree that you will not upload or transmit any communications or content of any type to the Public Areas (including blogs, forums, comments, other postings to the Site, etc.) that infringe or violate any rights of any party. By submitting communications or content to the Public Areas, you agree that such submission is non-confidential for all purposes. It is strictly prohibited to submit User Content of any kind that contain expressions of hate, abuse, offensive language or conduct, obscenity, or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions and the AbilityPath Privacy Policy.

User submissions — image, video, audio files

You agree to only post or upload Media (like photos, videos or audio) that you have taken yourself or that you have all rights to transmit and license and which do not violate trademark, copyright, privacy or any other rights of any other person. Photos or videos of celebrities and cartoon or comic images are usually copyrighted by the owner.

To protect your privacy, you agree that you will not submit any media that contains Personally Identifiable Information (like name, phone number, email address or web site URL.) of you or of anyone else. Uploading media like images or video of other people without their permission is strictly prohibited. You will also refrain from conveying medical sensitive information about you, your child or any one else you are related to or know that would infringe on HIPAA regulations.

By uploading any media on the AbilityPath site, you warrant that you have permission from all persons appearing in your media for you to make this contribution and grant rights described herein. Never post a picture or video of or with someone else unless you have their explicit permission.

It is strictly prohibited to upload media of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, sexually explicit or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions and the AbilityPath Privacy Policy.

You agree that you will not upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or this Site.

By uploading any media like a photo or video, (a) you grant to AbilityPath a perpetual, non-exclusive, worldwide, royalty-free license to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in the media; and (b) you certify that any person pictured in the submitted media (or, if a minor, his/her parent/legal guardian) authorizes AbilityPath to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in such media; and (c) you agree to indemnify AbilityPath and its affiliates, directors, officers, employees, and funders and hold them harmless from any and all claims and expenses, including attorneys' fees, arising from the media and/or your failure to comply with these the terms described in this document.

You agree that you may receive emails containing messages, articles, comments, endorsements, or other information from other users of the Site (“User Email”) who may do so by clicking on “send a message” in connection with your profile, the latter being linked to your email address. You acknowledge that AbilityPath has no authority or control over, and is not responsible for the content or other aspects of, or links in, any User Emails. Passwords

You grant AbilityPath and all other persons or entities involved in the operation of the Site the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Site. AbilityPath cannot and does not assume any responsibility or liability for any information you submit, or your or third parties' use or misuse of information transmitted or received using AbilityPath tools and services.

AbilityPath Community and member to member areas ("public areas")

If you use a Public Area, such as forums, blogs, or other member communities, you are solely responsible for your own communications, the consequences of posting those communications, and your reliance on any communications found in the Public Areas. AbilityPath, its funders and its licensors are not responsible for the consequences of any communications in the Public Areas. In cases where you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately. If you think you may have a medical emergency, call your doctor or 911 immediately.

In consideration of being allowed to use the Public Areas, you agree that the following actions shall constitute a material breach of these Terms and Conditions:

  1. Using a Public Area for any purpose in violation of local, state, national, or international laws;
  2. Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
  3. Posting material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by AbilityPath in its sole discretion;
  4. Posting advertisements or solicitations of business;
  5. After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);
  6. Posting chain letters or pyramid schemes;
  7. Impersonating another person;
  8. Distributing viruses or other harmful computer code;
  9. Harvesting or otherwise collecting information about others, including email addresses, without their identification for posting or viewing comments; consent;
  10. Allowing any other person or entity to use your identification for posting or viewing comments
  11. Posting the same note more than once or "spamming"; or
  12. Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Area or the Site, or which, in the judgment of AbilityPath, exposes AbilityPath or any of its customers, funders or suppliers to any liability or detriment of any type.

AbilityPath reserves the right (but is not obligated) to do any or all of the following:

  1. Record the dialogue in public chat rooms.
  2. Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).
  3. Remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform with these Terms and Conditions.
  4. Terminate a user's access to any or all Public Areas and/or the AbilityPath Site upon any breach of these Terms and Conditions.
  5. Monitor, edit, or disclose any communication in the Public Areas.
  6. Edit or delete any communication(s) posted on the AbilityPath Site, regardless of whether such communication(s) violate these standards.

AbilityPath, its funders or its licensors have no liability or responsibility to users of the Site or any other person or entity for performance or nonperformance of the aforementioned activities.

Advertisements, searches, and links to other sites

AbilityPath may provide links to third-party web sites. AbilityPath also may select certain sites as priority responses to search terms you enter and AbilityPath may agree to allow advertisers to respond to certain search terms with advertisements or sponsored content. AbilityPath is not responsible for the content of linked third-party sites, sites framed within the AbilityPath Site, third-party sites provided as search results, or third-party advertisements, and does not make any representations regarding their content or accuracy. Indemnity
